JUSTICE RAKESH KUMAR ORAL ORDER 03-05-2018 Heard Sri Raghunandan Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Chanpatia (Sirisiya O.P.) P.S. Case No.357 of 2017 registered for the offence under Section 392 of the Indian Penal Code (chargesheet has been submitted under Section 395 of the Indian Penal Code) and Section 27 of the Arms Act, has prayed for grant of bail.

Learned counsel for the petitioner submits that only on the basis of confessional statement of co-accused, the petitioner has been made accused. He further submits that nothing was recovered from the possession of the petitioner. However, on perusal of the statement made in

Patna High Court Cr.Misc. No.26824 of 2018(2) dt.03-05-2018 2/2 paragraph-3 of the petition, it is evident that the petitioner is accused in about 19 cases and some pertains to the offence either under Section 392 or Sections 394 and 395 of the Indian Penal Code.

Considering the fact that after investigation, chargesheet has been submitted as well as criminal antecedent of the petitioner , there is no reason to extend the privilege of bail.

The petition stands dismissed.
