====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 05-02-2020 Heard the learned advocate for the petitioner and the State.

The petitioner has approached this Court for a direction to the respondents to grant Matric trained scale to him from the date of appointment and senior scale after completion of 12 years of service.

Learned advocate for the petitioner has submitted that the issue has already been decided by a coordinate bench of this Court in C.W.J.C. No. 6139 of 2007 which has been approved by the Division Bench of this Court in L.P.A. No. 756 of 2015. The aforesaid decision has also been followed in C.W.J.C. No. 4907 of 2018 vide order

Patna High Court CWJC No.22866 of 2019 dt.05-02-2020 2/2 dated 12.04.2018 and in C.W.J.C. No. 6139 of 2007 (order dated 31.03.2011).

On the basis of the aforesaid statement made on behalf of the petitioner which has not been refuted by the counsel for the State, this writ petition is disposed of with a direction to the District Education Officer, Begusarai (respondent no. 3) to take a final decision on the claim of the petitioner for grant of Matric trained scale from the date of his initial appointment and senior scale from the date when he completed 12 years of service in the light of the decisions referred to above. The entire exercise in this regard must be completed within a period of sixty days from the date of receipt/production of a copy of this order. Needless to state that consequential benefits also be extended to the petitioner within a further period of thirty days from the date of such decision.

With the aforesaid direction/observation, the writ petition stands disposed of.
