The petitioners seek pre-arrest bail in connection with L.N.M.U. P.S. Case No. 192 of 2017 registered for the offences punishable under sections 341, 323, 324, 307/34 of the Indian Penal Code.
Referring to Annexure-3 to the application, learned counsel for the petitioner submitted that Irshad Ansari, son of informant had sustained only simple and superficial injury. It is submitted that there is no other injured and the occurrence took place on account of business rivalry and a counter case vide L.N.M.U. P.S. Case No. 191 of 2017 has already been registered
Patna High Court Cr.Misc. No.26434 of 2018 (2) dt.04-05-2018 2/2 prior to the institution of the instant case on the basis of the statement made by petitioner no. 1.
Learned counsel for the State opposes the application for grant of pre-arrest bail.
Considering the submissions made above specially the fact that the injuries on the person of the sole injured have been found to be simple in nature, in the event of arrest or surrender before the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with L.N.M.U. P.S. Case No. 192 of 2017, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) sushma/- U T
