The petitioner seeks pre-arrest bail in connection with Kesariya P.S. Case No. 184 of 2019 registered under Section 304B/34 of the Indian Penal Code.
The accusation is of killing of the daughter of the informant by her husband and in-laws, due to non-fulfillment of demand of dowry and she buffalo.
Submission is that the petitioner is the brother-in-law of the deceased, who used to reside outside the house with his father, Arun Paswan, who is not an accused in this case. More so, there is general and omnibus allegation of making demand of cash and she buffalo. Rupesh Paswan, husband of the
Patna High Court CR. MISC. No.73151 of 2019(2) dt.21-11-2019 2/2 deceased is already in custody.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Kesariya P.S. Case No. 184 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, III, East Champaran at Motihari, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
