2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 103(1), 3(5) of B.N.S. 3 . The prosecution case in brief, is that informant namely , Saurabh Kumar alleged that on 02.10.2024 , he got information that his son was not well and he has been admitted to Hospital. Upon such information , when informant came to the hospital, he took his son to JLNMCH for better treatment where his son was declared dead. Thereafter, informant raised suspicion against school administration and named accused persons for negligence and has also suspected that his son was assaulted.

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Informant is not an eye witness to the alleged occurrence . Only suspicion has been raised against his petitioner. Petitioner is principal of the school. During investigation, it has come that this petitioner along with hostel warden informant the informant about the incident telephonically and only after the son of informant was sent to K.K. Nursing Home for treatment whereupon he arrived along with informant. Upon enquiry, some of the student have stated that all of a sudden, the deceased felt unwell whereafter the wardeen was called and the deceased was taken to hospital for treatment. Petitioner claims clean antecedent. Similarly situated co-accused persons have already been granted bail by Co-ordinate Bench of this Hon'ble Court vide order dated 05.08.2025 in Cr. Misc. No. 1261 of 2025 .
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing
