2. The petitioner seeks regular bail in connection with Minapur P.S. Case No. 336 of 2024 registered for the offence under Section(s) 126(2), 115(2), 117(2), 74, 109, 303(2), 352, 351(3), 351(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner along with others have assaulted the informant with lathi and iron rod due to which the informant sustained injuries on his head and hand. When the wife of the informant came to rescue him, the accused tore her saree and took away her belongings of about Rs. 15,000/-

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 27.08.2025. He further submits

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Siddharth Sharma/ learned Judicial Magistrate, 1st Class (East), Court No. VIII/the concerned Court, Muzaffarpur in connection with Minapur P.S. Case No. 336 of 2024 subject to conditions that:- (i). The petitioner will mark his attendance at the concerned Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. (ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.

Patna High Court CR. MISC. No.78768 of 2025(2) dt.19-11-2025 3/3 (iii). The bailors will be close blood relatives of the petitioner.

At the time of acceptance of bail bonds, the concerned Magistrate will verify the fact that the matter has been settled among the parties by filing compromise petition and if the informant supports the compromise then the petitioner bail bonds shall be accepted and if the informant does not support the factum of compromise bail bonds of the petitioner shall not be accepted.
