JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 Petitioners seek bail in anticipation of their arrest in connection with Katihar Nagar P.S. Case No. 301 of 2019 registered for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

As per FIR petitioners have taken Rs.2,20,610/- from the informant for providing money loan and it also appears that they have taken money from other persons also and from the impugned order it appears that witnesses have supported the allegation.

Submission of learned counsel for the petitioners is that there is no chit of paper to show that they have taken money from the informant and others and allegation is false and

Heard learned APP, who has opposed the prayer for anticipatory bail stating that witnesses during investigation have supported the allegation that petitioners have taken money from them.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioners. They have to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
