The petitioner seeks bail in connection with Teghra P.S. Case no. 81 of 2018 registered under Sections 30/30(A) of Bihar Prohibition & Excise Act-2016.

619 lts. of foreign liquor is said to have been recovered in course of unloading the same from a Bolero pickup van and 8-10 accused persons managed to escape. Out of them, Petitioner (Bittu Kumar) and Golu Kumar were identified by the informant in the light of vehicle.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either

Patna High Court Cr.Misc. No.27036 of 2018(2) dt.03-05-2018 2/2 with the seized liquor or with the vehicle in question. He has been falsely implicated in the case at the instance of his enemy. He was not apprehended on the spot. Though, three more criminal cases have been lodged against the petitioner, but he is on bail in the said cases. He has been languishing in custody since 26.03.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Begusarai in connection with Teghra P.S.
