JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Pachrukhi ( G.B.Nagar) P.S. Case No. 202 of 2012 registered for the offences punishable under Sections 467, 468, 471, 406 and 120B of the Indian Penal Code .

Initially, the informant filed complaint case bearing Complaint Case no. 1981 of 2012 which was converted into the above stated case no. 202 of 2012.

Contents of complaint petition go to show that there is dispute between the two groups regarding Secretary of Managing Committee of School and both the parties have filed

Patna High Court CR. MISC. No.71185 of 2019(4) dt.29-09-2020 2/2 cases against each others.

No doubt, the F.I.R was registered in the year 2012 but the impugned order goes to show that the investigation was pending till passing the impugned order dated 26.08.2019. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Pachrukhi ( G.B.Nagar) P.S. Case No. 202 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
