2. Petitioner is an accused in connection with Gangabridge P.S. Case No.150 of 2023 registered under Section 414 of the I.P.C.
3. The allegation against the petitioner is that the police recovered a stolen vehicle (scooty) from possession of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner is neither the driver nor the owner of the seized scooty and he was going to purchase medicine at Hajipur. In the meantime, the police arrested him merely on the basis of suspicion and implicated him. The petitioner is a young man of
Patna High Court CR. MISC. No.81462 of 2023(2) dt.09-01-2024 2/2 19 years. It is further submitted that the petitioner has three criminal antecedents. There is no compliance of mandatory provision of Section 100 of the Cr.P.C.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the above facts and circumstances of the case as well as the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Hajipur, Vaishali in connection with Gangabridge P.S. Case No.150 of 2023.
