2. The petitioner has filed the instant Public Interest Litigation praying for a direction to the Additional Chief Secretary, Revenue and Land Reforms Department, Government
Patna High Court CWJC No.18332 of 2024 dt.06-12-2024 2/3 of Bihar, Patna to dispose of the representation dated 24.09.2024 filed by the petitioner for compliance of the recommendations of the Chairman, State Schedule Tribe Commission, Bihar, Patna.

The case of the petitioner in brief is that some persons belonging to the Schedule Tribe have been living for a long period in the District of Araria on certain land acquired by the Government pursuant to Ceiling Case no. 138/73-74 and 139/73-74 (State Versus Shekh Chootku and others). By order dated 26.7.2022 passed by the Sub-Divisional Magistrate, Araria in Case no. 538M/1986 ie a proceeding under section 145 Cr.P.C, the land was declared to be a private land. It is the case of the petitioner that on 3.7.2023, the Chairman of the Schedule Tribe Commission, Bihar, Patna has recommended to the respondent authorities to settle the matter in accordance with law and has also written a letter dated 26.7.2023 to the Collector, Araria and Superintendent of Police, Araria.
4. The petitioner has no concern with the Schedule Tribe Commission. So far as the order passed by the SubDivisional Magistrate, Araria in the proceeding under section 145 Cr.P.C is concerned, if any party is affected by the same, the same shall have to be challenged before the appropriate forum

5. Having heard the observation of this Court, learned counsel for the petitioner seeks permission to withdraw this application.
