Ms. Sharda Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-12-2025 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 303(2), 308, 308(2) and 3(5) of the B.N.S. and Sections 66(A) and 67(A) of the I.T. Act.

3. As per prosecution case, it is alleged that all the F.I.R. named accused persons, including this petitioner, committed robbery and sexual assault with the informant and also made a video footage of the sexual assault in order to threaten and extort money.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in

The present F.I.R. has been lodged after inordinate delay of about 1 month and 14 days and there is no plausible explanation for the same which itself makes the entire prosecution case doubtful. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other accused persons, robbed the informant, sexually assaulted him and made a video of the sexual assault in order to extort money.

6. Considering the aforesaid facts and circumstances of the case, specific and direct nature of accusation and gravity of offence, the prayer for grant of anticipatory bail to the petitioner is rejected.
