The petitioner apprehends his arrest in connection with Mansi P.S. Case No. 228 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 393, 307, 379, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner has been implicated in this case due to local politics since the co-accused is Mukhiya of Gram Panchayat Raj Sarsava and other accused are followers of the co-accused. The co-accused has won the election after defeating the informant. In the written report, it is alleged that on the date of occurrence while the informant was coming on the motorcycle
Patna High Court CR. MISC. No.73549 of 2019(2) dt.21-11-2019 2/2 along with his wife, accused who was on Scarpio vehicle stopped the informant and dragged him towards the Scarpio and on refusal, he assaulted the informant causing injury on his head. Learned counsel for the petitioner submits that the similarly situated co-accused has been granted anticipatory bail vide order date 25.04.2018 passed in Cr. Misc. No.17266 of 2018. He further submits that the injury report shows that the injury is simple in nature.
In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 228 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Nasimul/- U T
