JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 Earlier the prayer for bail of the petitioner was rejected twice vide order dated 06.03.2019 passed in Cr.Misc.No.10829 of 2019 and order dated 06.09.2018 passed in Cr.Misc.No.44926 of 2018 in connection with Gaighat P.S. Case No.335 of 2013 registered for the offence under Section 376/34 of the Indian Penal Code and later on Sections 4,7,8 and 10 of the POCSO Act.

Submission of learned counsel for the petitioner that statement of the victim girl as well as medical report does not support the prosecution case and the petitioner is in custody since 16.06.2018.

Heard learned Addl. Public Prosecutor.

In view of the seriousness of accusation, I am not inclined to enlarge the petitioner on bail. However, since the

Patna High Court CR. MISC. No.71863 of 2019(2) dt.29-01-2020 2/2 petitioner is in custody since 16.06.2018, the trial court is directed to take steps for expeditious trial at regular basis and at the same time, the Superintendent of Police Muzaffarpur is directed to ensure the presence of witnesses, so that the trial may be concluded as early as possible.
