2. The learned counsel for the petitioner has submitted that the petitioner was granted bail vide order dated 26.09.2024 passed in Cr. Misc. No. 66754 of 2024 and at the same time, the Court below was directed to verify the criminal antecedent of the petitioner which was verified and two cases of consumption of liquor were found against the petitioner. Learned Counsel for the petitioner has submitted that only for this reason, the petitioner has been punished by remaining four months in custody.

4. Considering the above-mentioned facts and

Patna High Court CR. MISC. No.82977 of 2024(2) dt.31-01-2025 2/2 circumstances, the Cr. Misc. No. 82977 of 2024 is allowed and the order dated 26.09.2024 is modified to that extent.

5. The criminal antecedent of the petitioner shall not be considered as hurdle in acceptance of the bail bond furnished by the petitioner.
