JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The petitioner, who is mother-in-law of the deceased seeks bail in connection with Sonbarsa Raj P.S. Case No. 100 of 2019 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that she is 70 years of age and has been made accused in this case only because she happens to be the mother of the husband of the deceased. Though there is allegation in the F.I.R but such allegation is only on hearsay information.

The death is stated to have been committed by administering poison to the deceased.

Patna High Court CR. MISC. No.72159 of 2019(4) dt.05-03-2020 2/2 The learned counsel for the petitioner has further informed this Court that the petitioner, because of her age is almost a recluse and does not have any say in the family.

Considering all these aspects of the matter, specially the period of custody which is from 10.07.2019, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Sonbarsa Raj P.S. Case No. 100 of 2019.
