ANJANA MISHRA ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 21.03.2018 in connection with Laxmipur (Gidhour) P.S. Case No.96 of 2018 registered for the offence under Sections 376, 511 of the Indian Penal Code and Section 8 of the POCSO Act.

Learned counsel for the petitioner submits that at best the petitioner can be implicated under Section 354A of the I.P.C. and not under Section 376, as has been alleged. It is further submitted that the entire episode had occurred on account of the fact that the petitioner had demanded his wages for the work done by him, which necessitated the wrath of the informant. In view of the aforementioned facts and circumstances

Patna High Court Cr.Misc. No.32940 of 2018 (3) dt.04-07-2018 2/2 and that the petitioner has got no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J., 1st (Special Court POCSO Act), Jamui, in connection with Laxmipur (Gidhour) P.S. Case No.96 of 2018.
