The petitioner seeks bail in connection with Bahadurganj P.S. Case No. 73 of 2019 (G.R. No. 432 of 2019), registered under Sections 366A, 323, 504, 506 and 34 of the Indian Penal Code.

The accusation is that in the evening of 08.03.2019, minor daughter of the informant, Rizwana Begum, has gone in the field to collect the she goat, but, she did not return. Thereafter, she went and collected the she goat, but, her daughter was not there. In course of search, she came to know that Anjar Alam has forcibly put her at his motorcycle and fled away. The informant went at the house of Anjar Alam and came to know that her daughter has been concealed in the house, then, she called her, her daughter came out of the house of Anjar Alam,

No.78169 of 2019(2) dt.09-12-2019 2/2 then, Anjar Alam, his father, Hamidur Rahman, his mother, Anjila Begum, his sister, Nazneen, and his brother, Anjir Alam (petitioner) gathered and carried her daughter in the house, saying that Anjar Alam will perform marriage with her daughter and they also abused and gave threatening.

Submission is that occurrence is said to be of 08.03.2019, but, the present case has been lodged on 11.03.2019, after three days of the occurrence. More over, allegation of kidnapping of minor daughter of the informant is against Anjar Alam and the petitioner, being the brother of Anjar Alam, has falsely been implicated in this case. The petitioner is in custody since 30.08.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bahadurganj P.S. Case No. 73 of 2019 (G.R. No. 432 of 2019) to the satisfaction of the Chief Judicial Magistrate, Kishanganj. (Rajendra Kumar Mishra, J) Shamshad/- U T
