JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 This is an application for grant of anticipatory bail in connection with G.O. Case No. 124 of 2013, disclosing offence under Section 47(A) of the Bihar Prohibition and Excise Act, 2016.

Case is of the year 2013. Petitioner is named in the F.I.R with allegation of recovery of 30 liters of country made liquor from the possession of the petitioner. Apart from that 200 kg of Mahua flower.

Submission of the learned counsel for the petitioner is that he has no knowledge about the recovery, as such, he could not appear earlier and case is under the old Excise Act. Heard learned A.P.P. also.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the

No.72462 of 2019(2) dt.17-01-2020 2/2 petitioner However, he has to surrender before the learned court below and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by order of this Court, and if, possible to be disposed of on the same day.
