Mr. Gauri Shankar Gupta ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 04-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Manjhagarh P.S.Case No. 159 of 2017 registered under Sections 307,324 and 341 of the Indian penal Code.

Allegation in brief is that petitioner gave a dagger blow causing injury on chest to abdomen of the informant. Submission is that there is case and counter case between both sides and petitioner has been implicated falsely in this case which is reflected from the fact that alleged occurrence is dated 20.08.2017 but the FIR was lodged after delay of 14 days i.e., on 04.09.2017 and no cogent reason is there. Moreover, petitioner had earlier filed anticipatory bail application and injury report also appears manipulated as for requisition of injury report, the Investigating Officer made the requisition on

Patna High Court Cr.Misc. No.29343 of 2018(4) dt.04-07-2018 2/2 20.02.2018 though injury report itself is dated 22.02.2018, Annexure-4A and the petitioner has been in custody in this case since 17.01.2018.

Whereas learned counsel for the informant opposes the prayer of bail and submits that injury is grievous in nature. Having considered the aforesaid facts and circumstances, the petitioner, namely, Satyendra Thakur, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Manjhagarh P.S. Case No. 159 of 2017.
