2. The petitioner seeks bail in connection with Jadiya P.S. Case No. 41 of 2025 registered for the offence under Section 80, 103(1) of the BNS.

3. As per the prosecution case, the petitioner and others are said to have killed the deceased for demand of dowry.

4. The petitioner is in custody since 29.06.205.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the case. He further takes this Court to paragraph 18 of the bail petition and has submitted that the only child born out of the wedlock is staying with the family of the petitioner.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Supaul/concerned Court below in connection with Jadiya P.S. Case No. 41 of 2025.

8. As a condition of this order, the Court below, before accepting the bail bonds of the petitioner, will verify the fact that the child born out of the wedlock is staying with family of the petitioner or not. It is made clear that the bail bonds of the petitioner shall only be accepted if the child is staying with the family of the petitioner.
