2. The petitioner seeks regular bail in connection with Sherghati P.S. Case No.1003 of 2023, registered for the offences punishable under Section 20/22 of N.D.P.S. Act.
3. As per the prosecution case, 400 gram Ganja was recovered under the bed of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and nothing has been recovered from the physical possession of petitioner or from his house. He further submits that the recovered Ganja comes under the category of small quantity. He also submits that petitioner has no criminal antecedent and he is in jail custody since 21.09.2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum- Special Judge, NDPS Act, Gaya in connection with Sherghati P.S. Case No.1003 of 2023.
