2. The petitioner seeks bail in connection with Nathnagar P.S. Case No. 248 of 2025 instituted for the offences punishable under Sections 8(c), 21(b) of the Narcotic Drugs and Psychotropic Substance Act, 1985.

3. As per the prosecution case, on search a black coloured polythene in which brown-sugar like material was found on a Chowki. On weighing the said brown-sugar was found 12.85 gm in weight.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that there is a joint house and the petitioner has no knowledge about the alleged occurrence, he has falsely dragged in this case. He

No.78146 of 2025(2) dt.03-12-2025 2/3 further submits that the alleged recovered articles are only 4.86 gm brown like substance which is come in the purview of small quantity and so the weight is about 12.86 gm is concerned which is along with Pudiya. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 29.07.2025.

5. Learned APP for the State opposes the prayer for bail.

From perusal of the FIR, and the impugned order of the learned Principal Sessions Judge, Bhagalpur dated 10.10.2025, it appears that on the basis of written report of the informant Sakeel Ansari, FIR has been registered under Sections 8(c), 21(b) of the Narcotic Drugs and Psychotropic Substance Act, 1985 and the allegation against the petitioner is that he was arrested with 4.86 gm brown like substance and the weight is about 12.86 gm which is along with pudiya. It also appears that petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 29.07.2025, so considering all these aspects of the case and submissions of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.

7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail after framing of charge on furnishing bail bonds of Rs.
