====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 27-06-2018 Heard Sri Md. S. Jamil Akhtar, learned counsel for the petitioners and Smt. Anita Kumari Singh, learned Additional Public Prosecutor.
Two petitioners, who are named in the F.I.R., apprehending their arrest in connection with Town P.S. Case No. 38 of 2018 ,registered for the offence under Sections 341, 323, 324, 307, 504, 447, 379/34 of the Indian Penal Code, 1860 , have prayed for grant of bail in the event of their arrest or surrender.
Learned counsel for the petitioners by way of referring to the F.I.R. submits that there is no specific accusation against petitioners regarding giving assault by any deadly
Patna High Court Cr.Misc. No.27924 of 2018(3) dt.27-06-2018 2/2 weapon , and as such, it is a fit case for grant of anticipatory bail.
However, on going through the F.I.R. it is evident that in the occurrence sharp cutting weapon was used and injury was received. Against petitioners also there is allegation of committing overt act , and as such, the court is of the opinion that it can not be a case for extending the privilege of anticipatory bail. Accordingly, the prayer for grant anticipatory bail in respect of both petitioners, namely (1) Zeeshan @ Md. Zeeshan Alam and (2) Faizan @ Md. Faizan Alam stands dismissed.
