The petitioner apprehends his arrest in Khagaria(Muffsil) P.S. Case No.147 of 2018 registered under Sections 135 and 138 of the Electricity Act.

The Junior Engineer inspected a business premise of the petitioner and found that the petitioner illegally connected the electric connection in his business premise. In the business premises, one hospital in the name of Aradhya Hospital and one Lakshya Hinglish Public School and Lakshya Coaching Centre were running. The petitioner is alleged to have theft the power energy worth Rs.4,77,201/-.

The learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.29305 of 2018 (2) dt.18-05-2018 petitioner is not the owner of the business premises. It appears that business premises standing in the name of the wife of the petitioner. The petitioner without taking any valid connection from North Bihar Power Distribution Company Ltd. illegally connected the electric connection and committed theft of power energy worth Rs.4,77,201/-.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail.

If the petitioner surrenders in the court below after depositing the entire amount i.e. Rs.4,77,201/- within two months from the date of receipt of this order, the learned court below shall enlarge the petitioner on regular bail.
