Petitioner seeks regular bail in connection with Excise Case No.454 of 2019, Computer Regn No.504 of 2019, for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation against the petitioner is that a total quantity of 14 litres of illicit country-made liquor has been recovered from the tea shop of the petitioner. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and has falsely been implicated in this case inasmuch as the tea shop is open from all sides and is easily accessible to all. Patna High Court CR. MISC. No.70694 of 2019(2) dt.04-12-2019 2/2 submits that the petitioner is in custody since 15.10.2019. Having regard to the submissions made by the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and he is in custody since 15.10.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. IInd-cum-Special Judge, Excise, Samastipur, in connection with Excise Case No.454 of 2019, Computer Regn No.504 of 2019.
