02. This is the second attempt of the petitioner to seek bail from this Court in connection with Session Trial No. 389 of 2025 arising out of Jagdishpur P.S. Case No. 291 of 2024, registered for the alleged offences under Sections 103, 238, 61(2), 3(5) of Bharatiya Nyaya Sanhita, 2023, his prayer for bail was earlier rejected vide order dated order dated 22.03.2025 passed in Criminal Misc. No. 74 of 2025.
03. As per the prosecution case, petitioner and other co-accused persons came to the house of the informant and took away his nephew with them. Next day, the dead body of the nephew of the informant was recovered and the informant showed his suspicion that the above named petitioner along with
Patna High Court CR. MISC. No.77883 of 2025(2) dt.21-11-2025 2/2 other co-accused persons murdered his nephew.
04. Learned counsel for the petitioner submits that the petitioner is in custody since 27.08.2024 and the charges have been framed against him. The petitioner would not interfere with the trial in any manner and there is no substantive material against him. The petitioner has got no criminal history.
05. Learned APP as well learned counsel for the informant vehemently oppose the submission made on behalf of the petitioner. Learned counsel for the informant submits that there is complete involvement of the petitioner and he was the person who took away the deceased. Thereafter, the dead body of the deceased was recovered. Learned counsel further submits that the trial has started in this case.

Having regard to the facts and circumstances and submission made on behalf of the parties, I do not think any fresh ground has been brought forward to consider the prayer for bail of the petitioner as his prayer for bail was earlier rejected vide order dated order dated 22.03.2025 passed in Criminal Misc. No. 74 of 2025. Therefore, I am not inclined to enlarge the petitioner on bail. Hence, his prayer for bail is rejected. (Arun Kumar Jha, J) Ashish/- U T
