08-05-2018 Heard Sri Shashank Shekhar, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, having clean antecedent, which fact has been stated in paragraph 3 of the petition, have prayed for grant of bail in Town P.S. Case No. 184 of 2018 registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
It was submitted by learned counsel for the petitioners that nothing was recovered either from premises of the petitioners or from conscious possession of the petitioners, however; it was shown, as if, from a tank near the house of the petitioners, huge quantity of Indian make foreign liquor was concealed, which was shown to be recovered and both the
Patna High Court Cr.Misc. No.27879 of 2018(2) dt.08-05-2018 2/2 petitioners have been made accused on false accusation. Be that as it may, considering the nature of accusation and clean antecedent, let both petitioners namely Pankaj Singh and Shivam Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Begusarai in connection with Town P.S. Case No. 184 of 2018.
