JUSTICE ARUN KUMAR ORAL ORDER 19-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 20.2.2018, seeks bail in Khirhar PS Case No. 45 of 2016 registered under Sections 376, 420, 120B of the IPC and Section 4 of Pocso Act.

The allegation in brief is that the petitioner on the pretext of getting married with the informant's daughter sexually exploited her and ultimately refused to marry the girl.

Learned Counsel for the petitioner submits that the petitioner is innocent and only to put pressure to marry with the informant's daughter false case was lodged against the petitioner, however the fact is that the girl is major and her age was assessed 17 years. Having considered the said facts and circumstances, the petitioner, namely, Sunder Sah is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of lst Additional Sessions Judge, Madhubani in connection with Khirhar PS Case No. 45 of 2016.
