The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending her arrest in a case registered under Sections 420, 379 of the Indian Penal Code. Prosecution case, in short, is that on 18.04.2018 the informant had gone to State Bank to active his ATM, an unknown person was standing behind him. He got his ATM active and went on upper floor of the Branch. In the meantime at 11.02 a.m., a message of transaction of Rs.20,000/- came on his mobile. He met with the manager of the Bank and eqnuired

Patna High Court CR. MISC. No.79708 of 2019(5) dt.07-09-2020 2/3 about the transaction, upon which it was disclosed that the amount has been transferred in the account of the petitioner. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is a lady. It is further submitted that the petitioner is ready to deposit an amount of Rs.20,000/- in the court below, which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs.20,000/- in the court below, which shall be subject to the final disposal of the case. On doing so, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of eight weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. case No.133 of 2018, subject to the conditions as
