1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Sahebganj Police Station Case No. 242 of 2024, dated 12.05.2024, disclosing offences punishable under Sections 302/120-B/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that the marriage of the petitioner was solemnized with the sister of the informant (now deceased) on 08.03.2008 and their two children were studying in boarding school, at Gorakhpur. It has been alleged that for the past 4-5 years, the petitioner had developed illicit relationship with one Dolly Jaiswal, which was being objected by the
Patna High Court CR. MISC. No.81377 of 2024(2) dt.11-12-2024 2/2 deceased, due to which the petitioner along with others killed the deceased.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive. He further submits that the deceased has committed suicide by jumping from the roof. He further submits that the petitioner informed the informant about the death of the deceased and the informant participated in the funeral of his sister and later on, lodged the First Information Report.
5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the gravity of the offence and the nature of allegation, I am not inclined to grant the petitioner privilege of anticipatory bail.
