2. The petitioner is in custody in a case registered for the offence punishable under Section 305 of BNS.

3. As per allegation in the FIR, the informant's plant namely, Amul Feed Pvt.Ltd was closed for the last two years and on 03.05.2025 at about 11:00 AM, he went there and found that someone entered into the plant and stolen several items.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case, petitioner is in custody since 13.07.2025, he has got no criminal antecedent stated in para-3 of the petition and the informant caught him only on the basis of suspicion.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Pinki Kumari, Judicial Magistrate 1st , Patna City, Patna/concerned Court in connection with Bypass P.S.
