2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 302/326 and other allied sections of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of the occurrence, petitioner (son of informant) set the wife of informant on fire by sprinkling kerosene oil causing her death.

4. Learned counsel appearing for the petitioner submits that during trial, till date, three prosecution witnesses including the informant have been examined but none of them has supported the prosecution case. The informant, in his cross examination, has denied the allegation and has stated that he was not present at the place of occurrence at the relevant time. Petitioner is in custody since 1.11.2022.

5. Considering the depositions of aforesaid witnesses and the period of custody of the petitioner, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge XII, Vaishali at Hajipur in Hajipur Sadar Police Station Case No. 866 of 2022.
