The petitioner, who is claiming himself to be the Chairman of the Pensioner Karamchari Sangathan, Nagar Parishad, Sasaram approached before this Court seeking a direction upon the respondent authorities to extend the benefit of pay scale of 6th Pay Revision w.e.f. 01.01.2006 to the retired eligible employees/pensioners of Nagar Parishad Sasaram/Nagar Nigam, Sasaram, which is made effective in Nagar Parishad, Sasaram.

At the outset, learned Advocate for the Municipal Corporation has drawn the attention of this Court to AnnexureP/1 to the writ petition where some of the employees of the Sasaram Municipal Corporation, including the petitioner of the present case, approached before this Court for identical relief. It is further contended that it has also not been disclosed that as to whether the association of the petitioner is a registered association or not. Moreover, the Association cannot be allowed to agitate the claim of the members in a service matter is the contention of the learned Advocate for the Municipal Corporation.

Considering the fact that the petitioner had earlier approached before this Court for identical relief wherein the Court had given liberty to the petitioner and others to file a detailed representation before the Executive Officer, Nagar Parishad, Sasaram within four weeks from today with a direction to consider the same in accordance with law and pass a speaking order, this Court does not find any reason to entertain the present writ petition.
5. The petition stands closed.
6. However, the closure of the writ petition would not come in the way of the other employees of the Municipal
