Case No. 62 of 2017, corresponding to Sessions Trial No. 132/2019/174/2019, registered for the offences punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR while informant was coming after withdrawing a sum of Rs.1 lac on a motorcycle, petitioner has taken lift from him and on way he fired at the back of informant, due to which he fell down and petitioner fled away after snatching the bag containing money.

Submission of learned counsel for the petitioner is that co-accused has been granted bail by order dated 25.9.2019 passed in Cr.Misc.No. 60509 of 2019 and he is in custody for two years.

Patna High Court CR. MISC. No.73668 of 2019(3) dt.04-02-2020 2/2 Heard learned APP and perused the report submitted by learned trial court, from which it appears that trial has commenced and four witnesses have already been examined. In view of nature of allegation, I am not inclined to grant bail to the petitioner. However, since the petitioner is in custody for two years, learned trial court is directed to expedite the trial and conclude the same within a period of nine months. This application is, accordingly, dismissed.
