JUSTICE RAKESH KUMAR ORAL ORDER 16-05-2018 Heard Sri Akhileshwar Prasad Singh, learned senior counsel, assisted by Sri Gautam Kumar Yadav, learned counsel for the petitioner , learned Additional Public Prosecutor as well as Sri Abhay Kumar, learned counsel for informant. The sole petitioner, apprehending his arrest in connection with Daniyawan P.S. Case No. 39 of 2018, registered for the offences under Sections 147, 148, 149, 324, 307, 385 of the Indian Penal Code, 1860 and Section 27 of the Arms Act, 1959, has prayed for grant bail in the event of his arrest or surrender.
Sri Akhileshwar Prasad Singh, learned senior counsel for the petitioner tried to persuade the Court that there is no specific accusation against petitioner and it is a fit case for
Patna High Court Cr.Misc. No.27959 of 2018(3) dt.16-05-2018 2/2 granting anticipatory bail. However, after examination of the F.I.R. it is evident that there is specific accusation against petitioner that he fired from his rifle which hit the thigh of the informant.
Considering the specific accusation against petitioner, there is no reason to pass favourable order. The prayer for grant of anticipatory bail stands dismissed.
