The petitioner is apprehending his arrest in a case in connection with Complaint Case No. C355 of 2022 dated 03.06.2022 registered for the offence/s punishable u/ss 498, 380, 365, 511, 384, 504, 506, 120B of the IPC but the cognizance has been taken u/ss 323,379, 365, 384, 354B read with section 34 of the IPC

3. As per the prosecution case, the petitioner is alleged to have lured the informant's wife and fled away with his wife and his two month old daughter by taking Rs. 200000/-and

When the informant went to the petitioner's house to inquire about his wife, the other accused persons started abusing him and also threatened him. After sometimes, the petitioner called the informant on mobile and said that your wife and child were with him and also threatened to kidnap him.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The informant's wife is the niece of the father of the petitioner. The victim is a married woman aged about 35 years having three children. As per FIR, the victim was kidnapped by the petitioner but the victim has not raised any alarm to save herself. The petitioner has one criminal antecedent as stated at para 3 of the bail petition.

5. Learned counsel for the informant as well as learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the allegation being general and omnibus, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees

No.78470 of 2025(2) dt.17-11-2025 3/3 twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Kishanganj in connection with Complaint Case No. C355 of 2022, subject to conditions as laid down under section 482(2) of the BNSS, with further condition/s:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
