The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a), 36, 38 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 191.22 litres of foreign liquor has been recovered from the house of co-accused Raja Kaushik. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 19.09.2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail, subject to deposit

Patna High Court CR. MISC. No.72493 of 2019(2) dt.25-11-2019 2/2 of Rs. 10,000/- in the court below/Nazarat, on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Ahiyapur Police Station Case No. 1144 of 2019.

Such deposit of Rs. 10,000/- shall abide by the outcome of the pending criminal case.
