The petitioner seeks bail in connection with Bairgania P.S. Case No. 64 of 2018 for the offences punishable under Sections 272, 273 and 414 of the Indian Penal Code and Sections 30A and 41 of the Bihar Prohibition & Excise Act, 2016. The allegation is regarding recovery of 30 liters of illicit liquor from a motorcycle which was being ridden by the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case inasmuch as the said motorcycle from which the recovery has been made does not belong to the petitioner herein. It is further submitted that the petitioner is having a clean antecedent and he is

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge cum Special Judge, Excise, Sitamarhi in connection with Bairgania P.S.
