The petitioner apprehends his arrest in connection with Kursakanta P.S. Case no. 145 of 2018, registered under Section 302 and 120(B) of the Indian Penal Code. The accusation is that on 30.06.2018, Md. Jakir Hussain, son of the petitioner Fazrul Rahman and Md. Bablu came at the door of the informant and accompanied his son Md. Asif to play cricket. After some times, his villager Sohan Kumar Paswan was passing through the Jute filed then heard the sound of screaming then raised alarm. Thereafter, two boys, pool of blood, started fleeing, out of which one boy apprehended, who disclosed his name Md. Jakir Hussain, who also disclosed the name of his associate Md. Bablu. Thereafter, they entered in the filed and found dead body of Md. Asif

Learned counsel for the petitioner submits that it would appear from the F.I.R. that Md. Jakir Hussain, son of the petitioner and one Bablu accompanied the deceased Asif, son of the informant to play the cricket and after some times, both were seen fleeing from the filed in which the dead body of son of the informant was found by co-villager Sohan Kumar Paswan, but with ulterior motive, the petitioner, being the father of co-accused Md. Jakir Hussain has falsely been implicated in this case. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Kursakanta P.S. Case No. 145 of 2018, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
