JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 18-11-2024 Heard the learned counsel for the petitioner, learned counsel for the State Election Authority and learned G.A. for the State.

2. Learned counsel for the petitioner submits that his father's name was not correctly mentioned in the draft voter list

Patna High Court CWJC No.17507 of 2024(2) dt.18-11-2024 2/3 regarding which the petitioner has filed objection within stipulated time. Despite that the final voter list was published with incorrect father's name and title of the petitioner and it is still incorrect.

Having no option, the petitioner filed representation before the Election Authority and vide letter no. नन. पप. / नन. प. 1-18/2024 खंड 1007 dated 16.11.2024, the Advisor of the Election Authority directed the concerned B.D.O.-cumReturning Officer, Dobhi, Gaya to correct the father's name of the petitioner in the voter list, after taking affidavits of two witnesses and self attested I.D. Proof. This specific direction of the Advisor of Election Authority was not obeyed by the B.D.O.-cum-Returning Officer, Dobhi, Gaya for the reasons best known to him.

4. The B.D.O.-cum-Returning Officer, Dobhi, Gaya is directed to correct the father's name of the petitioner in the voter list immediately and his nomination paper shall also be accepted, unless/otherwise there is any other reason for not accepting it.

5. The petitioner is directed to file affidavit of two witnesses along with their I.D. Proof in support of the direction

Patna High Court CWJC No.17507 of 2024(2) dt.18-11-2024 3/3 issued by the Advisor of Election Authority by tomorrow.

6. With these observation, the writ petition stands disposed of.
