The petitioner seeks regular bail in connection with Siwaipatti P.S. Case No. 176 of 2022 instituted for the offences punishable under Sections 323, 376, 379, 420, 504 and 506/34 of the Indian Penal Code.

It is case of sexual assault upon the informant by the accused persons including the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the petitioner established physical relation since last two years and both parties have filed compromise petition before the court below vide Annexure-P-4 to the present petition.

Patna High Court CR. MISC. No.81561 of 2023(2) dt.05-01-2024 2/2 Petitioner has got clean antecedent and he is in custody since 13.09.2023.

Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, both parties have compromised the case before the court below, and have been living together since last two years and in fact the informant is already married with the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, East, Muzaffarpur in connection with Siwaipatti P.S.
