====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Rampur P.S. Case No. 455 of 2017, registered for the offence punishable under Sections 413, 414/34 of the Indian Penal Code and Sections 25(1-b)a / 26/35 of the Arms Act. The allegation is regarding the co-accused Raja Babu having been apprehended whereupon stolen motorcycle as well as one country made pistol with live cartridges and other articles were recovered. On the confessional statement of the said Raja Babu, the name of the present petitioner has transpired during the course of the investigation.

No.30065 of 2018(2) dt.22-05-2018 2/2 The learned counsel for the petitioner submits that the petitioner is a non F.I.R. named accused person and no material whatsoever has come forth during the course of the investigation so as to make the petitioner responsible for the alleged crime. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 27.03.2018.

Having regard to the facts and circumstances of the case , I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S.
