JUSTICE RAKESH KUMAR ORAL ORDER 03-07-2018 Heard Sri Pramod Kumar Verma, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in connection with G.O. Case No. 158 of 2017 , registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
At the very outset, by way of referring to the statement made in paragraph no. 3 of the petition, learned counsel for the petitioner submits that petitioner is having clean antecedent. He further submits that in this case nothing was recovered from conscious possession of petitioner, rather in this case huge quantity of country made liquor was embedded in
Patna High Court Cr.Misc. No.34975 of 2018(3) dt.03-07-2018 2/2 river which was recovered and petitioner has falsely been made accused.
Considering the clean antecedent of the petitioner as well as the fact that nothing was recovered from conscious possession of petitioner , in the event of his arrest or surrender within a period of six weeks from today, let petitioner Pramod Kumar @ Pramod Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II cum Special Judge, Nawada / concerned court in connection with G.O. Case No. 158 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
