2. The petitioner apprehends arrest in connection with Makhdumpur (Tehta O.P.) PS Case No.387 of 2024 dated 31-07-2024, instituted under Sections 30(a) of the Bihar Prohibition and Excise, Act, 2018.

3. Allegation is of recovery of total 48.875 litres foreign liquor from the house of co-accused Chandan Kumar.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the petitioner has not been arrested at the spot, rather, the name of the petitioner has been disclosed by the local chaukidar. There is no recovery either

Patna High Court CR. MISC. No.83522 of 2024(2) dt.11-12-2024 2/2 from the conscious possession of the petitioner or from his house. The petitioner has no concern with the alleged recovery. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise-1, Jehanbad, in Makhdmpur (Tehta OP) PS Case No.387 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure,1973.

7. The application stands allowed.
