JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-03-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Ballia P.S. Case No. 73 of 2018 for the offenses under Sections 382, 393, 411, 34 IPC and 27 (2) Arms Act.
Allegation against the petitioner is that he has tried to snatch Bolero pick up at pistol point.
Learned counsel for the petitioner submits that admittedly the vehicle was not snatched and the same was released to the informant on Jimenama by the police. He further submits that the petitioner is in custody since 21.6.2019 and there is no recovery of any arms from the possession of the petitioner.

Case No. 73 of 2018, subject to the condition that immediately after release the petitioner shall report to the Civil Surgeon, Begusarai so that his services may be utilized as volunteer in the District Health Centre, Begusarai for a period of one month.
