The petitioner seeks bail in Bihta P.S. Case No.40 of 2019, registered under Sections 448, 341, 387, 504, 506 and 34 of the Indian Penal Code.

The informant alleged that four persons came on his shop for purchasing furniture but in the meantime, one person pointed pistol on him and he asked the informant to have talk on mobile. The caller disclosed his name as Ujjawal and demanded extortion of Rs.5,00,000/-. The informant further disclosed that the entire incidents was captured in the CCTV installed in his shop.

Learned counsel for the petitioner submits that the name of the petitioner figured in the case in the confessional

Patna High Court CR. MISC. No.72382 of 2019(3) dt.11-12-2019 2/2 statement of Chiku Kumar, the co-accused. Chiku Kumar has already been granted bail vide order dated 10.07.2019, passed in Cr. Misc. No.42565 of 2019. Ashutosh Kumar @ Gaurav, another co-accused has also been granted regular bail vide order dated 04.09.2019, passed in Cr. Misc. No.38990 of 2019. The case of the petitioner stands on the same footing. The petitioner is in custody since 20.06.2019. The petitioner has remained in jail for more than 51⁄2 months.

Considering the facts that similarly situated coaccused persons have already been granted bail and the petitioner has remained in jail for more than 51⁄2 months, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Danapur in connection with Bihta P.S. Case No.40 of 2019.
