The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Sections 11 (i)(a)(d) of the Prevention of Cruelty to Animals Act, 1960.
Prosecution case as lodged by the police personnel is that on secret information that cattle was being transported from Nepal to Lohagara Hat for illegal sale, a raid was conducted and arrested Shivu Lal Harijan (petitioner) along with Mahindra Alfa auto. Accordingly, a seizure list was prepared. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the
Patna High Court CR. MISC. No.72479 of 2019(2) dt.25-11-2019 2/2 present case due to suspicion. He submits that petitioner is the driver of the said vehicle and seized cattle are belonged to coaccused. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 31.08.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Chief Judicial Magistrate, Kishanganj in connection with Dighalbank Police Station Case No. 69 of 2019.
