The petitioner seeks regular bail in connection with Hulasganj P.S. Case No.49 of 2018 registered for the offences punishable under Sections 147, 148, 149, 307, 324 and 504 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R. 20-25 tractors came for loading sand without any chalan and on protest, the accused persons including petitioner started indiscriminate firing. The present case has been registered against 15 named and 10 unknown persons. It appears that the allegation of firearm injury is omnibus against 25 accused persons. None of the witnesses in course of trial have stated any specific act against this petitioner. The petitioner is in custody

Patna High Court Cr.Misc. No.29032 of 2018 (4) dt.28-06-2018 since 05.04.2018 having clean antecedent. It has submitted that the petitioner is neither tractor owner nor had any concern with loading of sand.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No.49 of 2018.
