2. The petitioner apprehends his arrest in Halsi Police Station Case No. 200 of 2023 registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code.
3. Allegedly, petitioner along with other accused persons is said to have instigated the informant's daughter to commit suicide and due to mental harassment, she committed suicide by hanging herself from the ceiling fan.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to ulterior motive. The allegation levelled against the petitioner is totally false and based on concocted facts. The deceased has committed suicide
Patna High Court CR. MISC. No.81820 of 2023(2) dt.04-01-2024 2/2 at her parental home where the petitioner and other co-accused persons were not present. Petitioner did not make any call to instigate the deceased to commit suicide. The real fact is that the deceased was in love with another person. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

Learned APP for the State as well as learned counsel for the informant opposed the prayer for bail and submitted that there is serious allegation against the petitioner that he along with other co-accused persons, tortured upon the informant's daughter due to non-fulfillment of dowry demand and instigated her to commit suicide and ultimately, fed up with daily harassment, she committed suicide in her parental house by hanging herself within two months of her marriage.
6. Considering the facts and circumstances of the case as well as nature of the offence, I am not inclined to enlarge the petitioner on anticipatory bail.
7. The prayer for anticipatory bail of the petitioner is hereby rejected.
